Notice on the Update of the Conference User Service Agreement

We have recently updated the Conference User Service Agreement and adjusted part of the terms in accordance with the current circumstances of the Conference. Thank you for your attention and support to the Conference, and we will continuously endeavor to provide better services.

 

The updated version of the Conference User Service Agreement will come into effect upon the publication of this notice.

The Conference User Service Agreement (the “Agreement”) is the valid contract entered between you, on the one hand, and Ant Blockchain Technology (Shanghai) Co., Ltd. (“Host”) and Alibaba Cloud Computing Co., Ltd. (“Alibaba Cloud” together with the Host refer to “we”, “us” or “our”), on the other hand, with respect to the account registration, ticket purchase, sign-up, exhibition services and other matters in relation to the Conference.

 

1. Please read the Agreement (those in bold in particular) carefully, and please do not proceed with your operation if you have any question about the content of the Agreement or any instructions on the web page. You may ask for our explanations via our official hotline [+86 0571 – 2688 5888]. Your click through the web page or your confirmation in any other way will be deemed as your consent to the Agreement.

2. If you are without or with limited capacity for civil conduct, please inform your guardian, and please read the Agreement and use our services under his/her guidance. If you are not from Chinese mainland (for the purpose of the Agreement, does not include Hong Kong Special Administrative Region, Macao Special Administrative Region or Taiwan), you are also required to comply with the laws in the country or region where you are a citizen. In addition, you acknowledge that neither the execution nor the performance of the Agreement violates the laws and regulations of the country or region where you are a citizen, you reside, or your operation or other businesses are conducted.

3. You may act in different identities, such as ticket purchaser and ticket user, during your use of our services. Please read the corresponding parts of the Agreement carefully to ensure that you have a full understanding of the services to be provided in the Conference.

 

1.       Introduction to Services

 

1.1    Conference” refers to the Inclusion Fintech Conference, which will be held in 2020 for the first time and whose full name is “Inclusion Fintech Bund Conference” (“Inclusion Bund Conference” or “Inclusion Fintech Conference” for short). For any subsequent Conference, the name may be adjusted accordingly depending on the venue or other factors.

 

You may check the name, date and time, venue, agenda and other information of the Conference and then select your preferred session and use services in relation to the Conference, including ticket purchase and sign-up, on the website of the Inclusion Fintech Conference (URL: www.inclusionconf.com and URL: www.inclusionconf.com/en, “Conference Official Website”, and/or the Alipay mini program called “Inclusion Bund Conference”, collectively the “Website”).

 

1.2    Alibaba Cloud will provide information technology support services for the Conference. Therefore, after your confirmation or completion of the relevant information on the relevant web pages of the Website, the Host will synchronize your information to Alibaba Cloud as necessary to provide you with the services hereunder. To improve your experience, if you participate in any other conference for which Alibaba Cloud provides information technology services, you may use the relevant information filed by you for the Conference at your option to avoid repetitive entry of information (the specific product functions will be subject to the agreements on services for other conferences and the scope supported by Alibaba Cloud).

 

2.       Registration and Use of Conference Account

 

2.1    [Eligibility of User]

 

2.1.1By submitting an application for account registration for the Conference, you represent that you have the capacity for civil rights in consistent with your civil conducts under the laws of the PRC (“you” or “your”).

 

2.1.2If you do not have such capacity aforesaid, you and your guardian shall be required to bear all adverse consequences arising therefrom in accordance with the laws.

 

2.1.3You shall also ensure that you are not subject to any trade restrictions or sanctions imposed by any country, international organization or other jurisdiction, or to any other restrictions under laws or regulations; otherwise, you may be unable to register an account for the Conference and use the services hereunder normally.

 

2.2    [Registration of Conference Account]

 

You may provide your registration information through either of the two following methods at your own option:

(1) You may choose to grant the authorization for your information through Alipay account, if you hold the identity card as a resident of the PRC, in which case the Host will, according to the scope of your authorization, obtain your Alipay user number, profile picture, nickname, sex, region and mobile number; or

(2) You may also complete information voluntarily for registration/login, in which case you will provide your e-mail address and set up your profile picture and nickname in accordance with the instructions on the web page.

 

2.3    [Lawful User Information] Your profile picture, nickname and other user information shall not be in violation of national laws and regulations or the relevant rules of the Website and/or Alibaba Cloud. If your user information contains any information that is in violation of the laws, or is suspected of infringing others’ rights, or is detrimental to the public order and social customs, or disrupts the operation of the Website and/or Alibaba Cloud, we may request you to modify it. If you fail to modify your user information or the circumstance mentioned above remains after modification, we may suspend or terminate the provision of the services in whole or in part to you without any liability.

 

2.4    [Account Kept at User’s Risk] Your account is to be set up and kept on your own. Except where necessary for you to log in to the Website to use the relevant services, we will not take the initiative to request you to provide the password of your account at any time. Therefore, you are advised to properly keep your account and make sure to log out of and leave the Website following correct steps at the end of your use thereof.

 

2.5    [Solely Responsible for Actions Taken Through Account] All the actions taken through your account (such as purchasing and signing up) shall be deemed as the expression of your true intentions. You hereby undertake that any information used during your use of the services provided by the Website and/or Alibaba Cloud through your account shall come from lawful sources, and that if the relevant information involves the legitimate rights and interests of any third party, you shall have obtained the relevant permission in advance. Upon receipt of any report or complaint in relation to you by the Website, we may provide necessary information, including the account, to the parties to the relevant dispute and the relevant authorities in such manner as required or permitted by relevant laws and regulations in order to resolve the dispute and protect the legitimate rights and interests of rightful owners.

 

2.6    [Application for Cancellation of Account by User] To cancel your account for the Conference, you may contact us via our official hotline [+86 0571 – 2688 5888], and your account will be canceled once your application is approved. We would kindly bring to your attention that upon your confirmation to cancel your account for the Conference, we will delete or anonymize your information in accordance with the relevant rules and regulations, unless such information is required to be stored by us for a statutory period under laws and regulations or as required by the regulators. Therefore, your cancellation of your account for the Conference will cause inconvenience to your exercise of after-sales rights.

 

2.7    [Freezing and Cancellation of Account] To the extent stipulated by laws and regulations, required by state authorities or necessary as specified in the rules of the Website and/or Alibaba Cloud, we may freeze or cancel your account, in which case you may be unable to further log in with or use your account for the Conference.

 

2.8    [Personal Use] Your account for the Conference is for your personal use, and each account corresponds to one legal subject only. Without our consent, your authorization, whether direct or indirect, to any third party to use your account for the Conference or to access information thereunder shall be invalid. If it is determined by us that your use of the account for the Conference may compromise your account security and/or the data security of the Website/Alibaba Cloud, we may refuse to provide the relevant services, terminate the Agreement, or freeze or cancel your account, and you may be held responsible for all adverse consequences caused thereby.

 

3.       Conference Services

 

3.1    Information Service

 

3.1.1[Official Website] The Website is the only official website of the Conference. All information in connection with the Conference (such as the Conference agenda and guest information) shall be subject to that published on the Website. You acknowledge that the Host has the right to amend or adjust the information in connection with the Conference published on the Website from time to time based on the actual situation.

 

3.1.2[Information Notice] You agree that, after your registration of account for the Conference, we may send you Conference-related news via the Website message, SMS, e-mail and other reasonable means, so that you may be informed of our events, products and services in a timely manner. We may contact you for matters relating to the Conference via the mobile number provided at your registration if necessary.

 

3.1.3[Information Synchronization] The information (such as Ticket Information and Ticket User Information) confirmed or provided by you on your initiative through the relevant service web pages of the Website will be synchronized to Alibaba Cloud for it to record such information in a timely and accurate manner and to provide you with the relevant information technology services. Meanwhile, through the relevant service web pages of the Website, you may inquire conveniently and quickly the Ticket Information, order information and the Ticket User Information confirmed or provided by you, or choose to reset or share invitation code, cancel or delete orders, recall tickets, apply for invoices, or conduct other operations. In such event, we will synchronize information to Alibaba Cloud as necessary in accordance with your specific operation, so as to complete your order.

 

3.1.4As we deeply respect your personal information and privacy, the Host undertakes to protect and process your information in strict accordance with the provisions of the Privacy Policy of Ant Financial, and Alibaba Cloud undertakes to protect and process your information in strict accordance with the provisions of its Privacy Policy.

 

3.2    Ticketing Service

 

(1)        Anyone purchasing tickets is required to select the type, date, price, quantity and benefits of and other necessary information on the tickets to be purchased (“Ticket Information”) in accordance with the instructions on the web pages. At the same time, we will require the payment reference number and payment status to provide you with a purchase confirmation..

(2)        To ensure the safety and improve the experience during the Conference, ticket users are required to attend the Conference on a real-name basis. Those from Hong Kong, Macao, Taiwan and overseas who have purchased tickets may complete the Ticket User Information and share tickets with ticket users.

(3)        You are required to complete the Ticket User Information (including the name, sex, mobile number, e-mail address, contact address, number of valid certificate and job title, subject to specific instructions on the web pages, “Ticket User Information”) in accordance with the instructions on the web pages. If you are not the ticket user, please ensure that you have been legally and validly authorized by the ticket user before completing the Ticket User Information.

(4)        In case of any error in the Ticket User Information, the ticket purchaser is required to recall the relevant ticket, complete the Ticket User Information again, and re-send the ticket.

(5)        Given the ticket shows the qualification for attendance and is time-sensitive, any ticket refund will affect the legitimate rights and interests of the Host and other attendees of the Conference. Therefore, please check your order information carefully and place the order prudently. The ticket refund rules are as follows:

(a)            If you demand a ticket refund, you shall apply for ticket refund at least 30 days before the commencement date of the Conference; otherwise, such application will not be accepted by us.

(b)            In the event of force majeure (including but not limited to public health emergencies, epidemics, pandemics or infectious diseases, earthquakes, typhoons, floods, lightning, fires, terrorist attacks, explosions, wars, government intervention, policy and legal changes and other unforeseeable events beyond our reasonable control, “Force Majeure Events”), the Conference may be cancelled or postponed. Upon confirmation of such cancellation or postponement, we will publish relevant information and ticket exchange and refund policy on the relevant web pages of the Website as soon as possible, and we take reasonable methods to bring to your attention. You fully understand and agree that, in the event that the Conference is cancelled due to Force Majeure Events, the Host has the right to cancel the order and to provide a full refund of the actual purchasing price to your original payment methods. In the event that the Conference is postponed due to Force Majeure Events, you may handle the tickets in accordance to the instructions on the Website. You agree that, in the event of cancellation or postponement due to the Force Majeure Events, we are not in breach of the Agreement nor liable for your damages incurred.

(6)        In the event that you purchase any ticket on behalf of another person, you undertake that you have obtained the full authorization of such person to submit the confirmation of legal documents including the Agreement on his/her behalf, and that such confirmation of the Agreement and other legal documents in relation to the purchase of tickets shall be deemed as his/her confirmation. You shall be responsible for any consequence or liability arising out of your breach of above undertakings.

(7)        To ensure the lawful interests of the users and the Host, we have the right to cancel the corresponding order in case of any abnormal purchase of tickets.

 

3.3    Activation of Tickets (Applicable to Ticket users from Hong Kong, Macao, Taiwan and Overseas Only)

 

(1)        Those who have purchased tickets are required to complete the Ticket User Information and distribute the tickets to ticket users, who are required to activate the tickets. Please note that ticket users will not be admitted to the Conference with unactivated tickets.

(2)        Those who have purchased the tickets have the right to recall the same at any time before they are activated by the ticket users. Tickets which have been activated by the ticket users may not be recalled by their purchasers without the consent of the ticket users.

(3)        If a ticket purchaser intends to add himself/herself as the ticket user, he/she must fill in the e-mail address that is used for the registration of his/her account for the Conference on the Conference Official Website for him/her to access “My Tickets” and to find the ticket voucher. Where a ticket purchaser intends to add another person as the ticket user, we will notify such ticket user via e-mail, and the ticket user must click the link in the e-mail to visit web page under the Conference Official Website for Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan and overseas users to register an account for the Conference with the above e-mail address for him/her to activate the ticket voucher.

(4)        If the ticket user of any distributed ticket needs to be replaced, we only support such replacement by the ticket purchaser, in which case, the purchaser of such ticket is required to recall and distribute the ticket again on the Conference Official Website. Any ticket which has been activated by the ticket user may not be recalled unless with the consent of such ticket user.

(5)        To ensure the safety and improve the experience during the Conference, ticket users are required to attend the Conference on a real-name basis. During the Conference, ticket users must provide identity certificates and ticket vouchers consistent with the information filled in by the ticket purchasers to verify their identities offline to get badges before entrance.

 

If the ticket users have citizen identity card of the People’s Republic of China, ticket purchaser shall notify ticket users the tickets activation procedure in accordance with the tickets activation guideline published on the FAQ page of the Website access for Chinese Mainland users (www.inclusionconf.com).

 

3.4    Application for Invoicing

 

(1)        Ticket purchasers may apply for invoicing via the relevant service web page on the Website. In such case, ticket purchasers are required to fill in necessary information such as invoice title, tax information, recipient information, receipt address information and remarks in accordance with the instructions on such web page.

(2)        The Host will send the relevant invoice documents in a timely manner based on the information confirmed or provided by the ticket purchasers.

 

3.5    Minors

 

If you bring a minor to the Conference with the consent of the organizer, you agree and undertake that:

(1)        you are the legal guardian or another person authorized by the legal guardian of such minor, and you will only bring the minor to the interactive innovation exhibition of the Conference (the name of the exhibition shall be subject to adjustment by the Host) in compliance with national laws and regulations and the requirements of the Host and the organizer, and not to any other events;

(2)        you will accompany and take good care of the minor throughout the whole process to avoid potential dangers when he/she is left unattended;

(3)        you will ensure that the minor is physically healthy and without discomfort, injuries, pains or other illnesses that may affect his/her participation in the event. You agree to be liable for any injury to the minor arising from or during the event, or any personal injury and property damage caused thereby to a third party; and

(4)        you understand and agree that in case of any personal injury or property damage to the minor caused by unpredictable events or force majeure such as accident, drastic changes in the weather or acute illness, the Host and the organizer will provide relief on the principle of humanitarianism and shall not be held liable therefor.

 

3.6    You agree that the Host may shoot videos on the Conference venue for the live stream and rebroadcast of the Conference.

 

3.7    Limitation of Liability

 

We disclaim any liability caused by our failure to provide services normally, if such failure is due to any of the following reasons:

(1)        shutdown of our system for maintenance or upgrade;

(2)        Force Majeure Events;

(3)        breakdown of your software, hardware, telecommunications and power supply;

(4)        your improper operations or your use of our services in a way that is not authorized or acknowledged by us; and

(5)        attacks by virus, Trojan and malicious programs, network congestions, unstable systems, failure of system, equipment, communications or power supply, banking problems, third-party service defects or government acts.

Notwithstanding the foregoing, we will take reasonable actions to actively restore the services.

 

4.       Suspension or Termination of the Agreement

 

4.1    You may cease the use of our services at any time, though we will feel very sorry for that.

 

4.2    We will use our best efforts to safeguard your rights and interests, and make continued efforts to provide better services to you. Please understand that we may halt, suspend or terminate the provision of services to you if:

(1)        it is required by laws, regulations or policies, by regulators, or for risk control;

(2)        you breach the provisions hereof;

(3)        you use the service for illegal purposes or to infringe the legitimate rights and interests of others;

(4)        we are unable to provide our services due to Force Majeure Events; or

(5)        we have notified you of ceasing the provision of services via announcement or in any other method in advance.

 

5.       Miscellaneous

 

5.1    To ensure the public health security, you understand that we may take necessary health safety measures. You agree that, in compliance with the epidemic prevention policies required by the PRC or the local authorities where the Conference will be held, before entrance you will cooperate to provide necessary health certificates or to accept health checks, in specific including but not limited to displaying health codes, providing latest nucleic acid test reports, or taking body temperature. You understand and agree that we will only allow entrance of participants who comply with the epidemic prevention policies.

 

5.2    In order to further improve user experience, we will continue to update services to provide users with updates of services and contents such as version upgrades, function upgrades and rule upgrades, and the Agreement may also be amended accordingly, which will take effect on the date when the amended Agreement is published. If you disagree with the updated provisions, you have the right to cease the use of relevant services. The relevant services and corresponding provisions may also be separately modified upon mutual agreement. If the update will affect your major rights or responsibilities, we will notify you of the same via announcement, notification on the client application or SMS.

 

5.3    The execution, effectiveness, performance and interpretation of the Agreement shall be governed by the laws of the PRC (for the avoidance of doubt, excluding laws of Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan solely for the purpose of the Agreement). Any dispute between the parties arising out of the performance of the Agreement shall be solved through negotiation. Should such negotiation fail, either party may bring a lawsuit to the competent people’s court at the place where the defendant is domiciled.
