General Terms and Conditions of “Taobao x AlipayHK Double 11 Offers”:

1. The promotion period of Offer 1 is from 31 October to 30 November 2022, both dates inclusive (“Promotion Period of Offer 1”); The promotion period of Offer 2 is from 8 November to 11 November 2022, both dates inclusive (“Promotion Period of Offer 2”)
(Promotion period of Offer 1 and Offer 2 are collectively referred as “Promotion period”)

2. Customers must settle the payment at Taobao mobile application or Taobao platform via AlipayHK App （”AlipayHK APP”）with Hang Seng Visa Credit Card or Mastercard® Credit Card (“Eligible Credit Card(s)”) to enjoy “HKD30 Instant Discount for New Customer” (“Offer 1”) or “HKD30 Instant Discount for Existing Customer” (“Offer 2”). (Offer 1 and Offer 2 are collectively referred as “Offers”). Offers are not applicable to Hang Seng UnionPay Credit Card, UnionPay Renminbi Diamond Commercial Card, Renminbi Credit Card, USD Visa Gold Card, Spending Card and Private Label Card.

3. Eligible Transactions refers to the transaction made via AlipayHK with linked Eligible Credit Cards in Hong Kong Dollars and posted to the Eligible Credit Card account during the Promotion Period, including the orders on Taobao mobile application or Taobao platform but not acceptable to orders paid for outside of the mobile app, orders through the Xianyu platform, virtual goods (including but not limited to anything that does not require shipment, e.g. virtual currency, prepaid cards, etc.), or any other circumstances as specified by Taobao (“Eligible Transaction(s)”).

4. The purchase amount shall be determined based on the real-time exchange rate in the AlipayHK system at the time of the transaction. The “Currency” tool in the AlipayHK App is for reference only.

5.During the Promotion Period, each Eligible User may only participate in this Promotion once in accordance with the relevant Terms and Conditions, and receive such limited number of Coupons / Rewards within the Promotion Period as set out in the relevant terms and conditions. For the avoidance of doubt, “each Eligible User” refers to a natural person with legal capacity who uses the AlipayHK App and Wallet service, but not merely an AlipayHK account (“Eligible User”). To further avoid any dispute, in the following circumstances, the relevant accounts will be deemed to be used by the same user:

(i) Connection on the same mobile phone or mobile device, such as the logging in or activation of multiple accounts; or

(ii) Connection of an AlipayHK account or mobile number on multiple mobile phones or mobile devices, such as the logging in or activation on such devices; or

(iii) The same credit card number being connected to multiple AlipayHK APP accounts.

In the case of any of the above, in order to verify the user’s identity and prevent the risk of theft or misuse of such AlipayHK account, mobile phone number, mobile device or credit card number, AlipayHK reserves the right to suspend or terminate the release of any Coupon/Reward to the relevant account and to take legal action.

6. AlipayHK App is operated by Alipay Payment Services (HK) Limited (“AlipayHK”).

7.If there is any breach of these terms and conditions or illegal, fraudulent or abusive behavior during the Promotion Period, or if any user commits any act affecting other users’ ability to participate in the promotion fairly, AlipayHK will forfeit such user’s reward and entitlement of the Offer forthwith without notice, and reserves the right to cancel such transaction and to take legal action against the relevant user.

8.Any transactions which are eventually cancelled / returned or found to be fraudulent will be considered as ineligible transactions which are not applicable to this promotion and rewards will not be rewarded.

9.By participating in this promotion, customers accept and agree that AlipayHK may use his/her personal information in accordance with AlipayHK’s privacy policy.

10.Offers can be used in conjunction with red packets, merchant discounts, shopping rewards, etc. on Taobao, and shall be subject to the actual payment page which shall prevail. Offers are not transferable, non-exchangeable and cannot be redeemed for cash or other products, and cannot be used in conjunction with other Hang Seng Credit Card promotional offers unless otherwise specified. For goods return or refund, the amount on the Offers will not be returned and the relevant Offers will not be re-issued.

11. Cancellation or refund (if applicable) has to be arranged directly via Taobao mobile application or Taobao platform and is subject to the terms and conditions of respective platform. Offers which are subsequently modified will be considered as invalid. Customers will have to cancel the original Eligible Transactions/orders and re-purchase in order to enjoy the Offers again. The customers may not be guaranteed to enjoy the Offersagain if the quota has been used up at the time they make the order again.

12. If there is any breach of these terms and conditions or illegal, fraudulent or abusive behavior during the Promotion Period, or if any user commits any act affecting other customer’ ability to participate in the promotion fairly, AlipayHK will forfeit such customer’s reward and entitlement of the Offers forthwith without notice, and reserves the right to cancel such transaction and to take legal action against the relevant customer.

13. Hang Seng and the Merchant will not accept any liability should Customer fails to redeem the Offers.

14.All products, services and information related to AlipayHK are directly supplied to customers by designated merchants who are solely responsible for all related obligations and liabilities. Hang Seng and AlipayHK shall not be liable or construed as providing any guarantee as to the quality and availability of the products and/or service provided by designated merchants.

15.No person other than the customer, Hang Seng (which includes its successors and assignees) and AlipayHK (which includes its successors and assignees) will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provision of these Terms and Conditions.

16. These Terms and Conditions are governed by and will be construed in accordance with the laws of the Hong Kong Special Administrative Region.

17. These Terms and Conditions are subject to prevailing regulatory requirements.

18.The Offers are governed by these Terms and Conditions and other terms and conditions stipulated by the AlipayHK.

19.Hang Seng and AlipayHK reserve the right to vary or terminate the above offers at any time and to amend the terms and conditions from time to time. In case of disputes, the decision of Hang Seng and AlipayHK shall be final.

20. In case of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.

Specific Terms and Conditions of " HKD30 Instant Discount for New Customers" (“Offer 1”)

1. During the Promotion Period of Offer 1, customers who have successfully linked their Eligible Credit Cards via Taobao to AlipayHK App for the first time (“New Customers”) and make an Eligible Transaction of a single net spending of HKD220 or above at Taobao Mobile application or Taobao platform can enjoy HKD30 instant discount.

2. Offer 1 is available in a quota cap of 20,000 for New Customers, which is limited in quantity and on a first-come-first-served basis. The quota of Offer 1 available as recorded in the system of AlipayHK shall prevail under any circumstances. Each New Customer can enjoy Offer 1 once.

3. A customer who has ever linked Eligible Credit Card to the AlipayHK App on or before 30 October 2022, and/or delinked and link up Eligible Credit Card to the AlipayHK App during the Promotion Period will defined as existing customer and cannot enjoy Offer 1. Customer whose AlipayHK account/mobile phone number/mobile device/credit card number has ever been used for adding any Eligible Credit Card to the AlipayHK App will be defined as existing customer and cannot enjoy Offer 1.

Specific Terms and Conditions of " HKD30 Instant Discount for Existing Customers" (“Offer 2”)

1. During the Promotion Period of Offer 2, customers who have successfully added their Eligible Credit Cards to AlipayHK App and make an Eligible Transaction of a single net spending of HKD400 or above at Taobao Mobile application or Taobao platform can enjoy HKD30 instant discount.

2. Offer 2 is available in a quota cap of 30,000 for Existing Customers, which is limited in quantity and on a first-come-first-served basis. The quota of Offer 2 available as recorded in the system of AlipayHK shall prevail under any circumstances. Each Existing Customer can enjoy Offer 2 once.

「淘寶 x AlipayHK雙11優惠」之一般條款及細則︰

1. 優惠1之優惠期由2022年10月31日至11月30日，包括首尾兩日（「優惠1之優惠期」）；

優惠2之優惠期由2022年11月8日至11月11日，包括首尾兩日（「優惠2之優惠期」）。

2. 客戶於手機淘寶或淘寶平台購物並透過AlipayHK APP (「AlipayHK APP」)並以恒生Visa信用卡或Mastercard信用卡（「合資格信用卡」）簽賬，方可享有「新客戶即減HKD30獎賞」（「優惠1」）或「現有客戶即減HKD30獎賞」（「優惠2」）(優惠1及優惠2合稱「優惠」) 優惠均不適用於恒生銀聯信用卡、銀聯人民幣鑽石商務卡、人民幣信用卡、美元Visa金卡、消費卡及專享卡。

3. 合資格交易爲客戶於優惠期内憑已綁定的合資格信用卡經AlipayHK APP以港幣結算及已誌賬之合資格交易，適用於以AlipayHK APP付款之手機淘寶或淘寶平台訂單但不適用於以下幾種情況的淘寶訂單：非手機應用程式付款的訂單、閑魚平台的訂單、非實物類商品的訂單(包括但不限於虛擬幣、話費充值卡等毋須物流配送的商品訂單)，或其他根據淘寶規定不支持使用的類目（「合資格交易」）。

4. 付款簽賬將按交易當時AlipayHK APP系統內的實際交易匯率判定。AlipayHK APP內的匯率換算工具只供參考。

5. 於優惠期內，每一位用戶(「客戶」)僅限根據本條款及細則參與優惠一次。為免疑慮，「每一位用戶」是指使用AlipayHK APP和錢包服務的、具有法律行為能力的一名自然人，而非一個AlipayHK賬號。為進一步避免爭議，在下述情形，有關賬號將被視為由同一位用戶所使用：

（i）在同一部手提電話或移動設備上有關連，比如有多個賬號登錄或激活

（ii）若同一個賬號或手機號碼在多部手提電話或移動設備上有關連，比如登錄或激活；或

（iii）若同一張銀行卡號被綁定於多個AlipayHK APP賬號時。

6. AlipayHK APP為Alipay Payment Services (HK) Limited (「AlipayHK」) 所運營及管理之儲值支付工具。

7. 當以上情況發生時，為確認領獎的用戶資格及預防賬號、設備或銀行卡被盜用的風險，AlipayHK保留暫停或永久停止向相關賬號發放禮券/獎賞的權利及保留追究權利。

8. 任何最終被取消 / 退回或被發現為虛假之交易均不適用於是次優惠推廣及不會獲取額外獎賞。

9. 客戶參加本優惠活動，即表示其接受並同意受本條款及細則約束，及同意AlipayHK根據AlipayHK「私隱政策」使用其個人資料作本優惠活動之用。

10. 優惠可與淘寶紅包、商家優惠、購物津貼等疊加使用，並以實際付款頁面為準。除特別註明外，優惠不可與其他恒生信用卡優惠或折扣同時使用，亦不能兌換現金或其他貨品及不可轉讓。如需退貨或退款，優惠所對應的金額將不作為退款款項，而相關禮券/獎賞將不獲補發。

11. 取消和退改(如適用)需在手機淘寶或淘寶平台進行，並需要按相關之平台所設之退改條款處理。如對已使用優惠之合資格簽賬/訂單作出更改或退款，該訂單所享之優惠將被作廢，客戶須取消合資格簽賬/訂單並重新溑費方可再次使用優惠。客戶於再次溑費時會可能因當時優惠之使用額度己用完而未能使用相關之優惠。

12. 如果出現任何違反本條款與細則、違法、欺詐或濫用行為或發現客戶從事有礙其他客戶公平參加本推廣的行為，AlipayHK將取消該客戶的優惠資格而毋須另行通知，並有權撤銷任何涉及違規行為的交易及向有關客戶追討損失。

13. 恒生及AlipayHK於任何情況下均不會對客戶未能成功使用有關優惠而負上任何責任。

14. 此優惠所涉及與AlipayHK相關之產品、服務及資訊均由指定商戶直接提供給客戶，因此，恒生及AlipayHK對指定商戶提供之產品及服務質素及供應量恕不負責。

15. 除客戶、及恒生 (包括其繼承人及受讓人)及AlipayHK(包括其繼承人及受讓人)以外，並無其他人士有權按《合約（第三者權利）條例》強制執行本條款及細則的任何條文，或享有本條款及細則的任何條文下的利益。

16. 本條款及細則受香港特別行政區法律所管轄，並按照香港特別行政區法律詮釋。

17. 本條款及細則受現行監管規定約束。

18. 優惠須受此條款及細則及AlipayHK的其他條款及細則約束。

19. 恒生及AlipayHK保留隨時更改或終止以上優惠及不時修訂優惠條款及細則之權利。如有任何爭議，恒生及AlipayHK保留最終決定權。

20. 本條款及細則的中英文文本如有歧異，概以英文本為準。

「新客戶即減HKD30獎賞」(「優惠1」)之條款及細則：

1. 於優惠1之優惠期內經淘寶App首次綁定的合資格信用卡資格之新客戶(「新客戶」) 及透過AlipayHK App於手機淘寶或淘寶平台消費單一合資格交易滿HKD220或以上，即減HKD30。

2. 優惠只限首20,000位新客戶，先到先得，額滿即止。在任何情況下以AlipayHK的紀錄為準。每位新客戶最多可享折扣優惠一次。優惠須視乎AlipayHK平台所反映的優惠名額使用情況而定。

3. 如客戶於2022年10月30日或之前曾綁定合資格信用卡至AlipayHK App及/或於優惠1之優惠期內解除綁定並重新綁定合資格信用卡之客戶均被視為現有客戶，不可享有優惠1之獎賞。客戶的AlipayHK賬號/手提電話號碼/手機設備於優惠期前曾經與任何合資格信用卡綁定於AlipayHK App，則該客戶將被視為現有客戶，不可享有優惠1之獎賞。

「現有客戶即減HKD30獎賞」(「優惠2」)之條款及細則：

1. 於優惠期內經AlipayHK App憑已綁定的合資格信用卡透過AlipayHK App於手機淘寶或淘寶平台消費單一合資格交易滿HKD400或以上，即減HKD30。

2. 優惠只限首30,000位現有客戶，先到先得，額滿即止。在任何情況下以AlipayHK的紀錄為準。每位現有客戶最多可享折扣優惠一次。優惠須視乎AlipayHK平台所反映的優惠名額使用情況而定。
